{"id":33109,"date":"2022-05-11T13:32:21","date_gmt":"2022-05-11T18:32:21","guid":{"rendered":"https:\/\/sites.imsa.edu\/acronym\/?p=33109"},"modified":"2022-05-11T13:32:21","modified_gmt":"2022-05-11T18:32:21","slug":"judge-ketanji-brown-jackson-a-historically-impactful-judge-may-not-have-an-impact-on-the-supreme-court","status":"publish","type":"post","link":"https:\/\/sites.imsa.edu\/acronym\/2022\/05\/11\/judge-ketanji-brown-jackson-a-historically-impactful-judge-may-not-have-an-impact-on-the-supreme-court\/","title":{"rendered":"Judge Ketanji Brown Jackson, a Historically Impactful Judge, May Not Have an Impact on the Supreme Court"},"content":{"rendered":"<p><span style=\"font-weight: 400\">On April 7, 2022, the Senate confirmed Judge Ketanji Brown Jackson to the Supreme Court, making her the first Black woman to ever serve on the Court.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400\">There have been 115 justices in 232 years prior to Judge Jackson, and the Senate confirmed her in a 53-47 vote with three Republicans\u2014Susan Collins of Maine, Lisa Murkowski of Alaska, and Mitt Romney of Utah\u2014joining all of the Democrats in support of her confirmation.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cThis is a moment of real change,\u201d President Biden <\/span><a href=\"https:\/\/www.cnbc.com\/2022\/04\/08\/ketanji-brown-jackson-touts-confirmation-as-supreme-courts-first-black-woman-justice.html\"><span style=\"font-weight: 400\">said in a speech<\/span><\/a><span style=\"font-weight: 400\"> outside the White House.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400\">Although it is a serious win for many across the country, her confirmation was a difficult process. She had to sit through three long days of confirmation hearings where Republicans were not taking it easy on her.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400\">Regardless of the difficulty at these hearings, she was controlled and calm. Only two Black men, Thurgood Marshall and Clarence Thomas, have ever been appointed.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cJudge Jackson\u2019s confirmation was a historic moment for our nation,\u201d Biden <\/span><a href=\"https:\/\/twitter.com\/POTUS\/status\/1512139093135835153?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1512139093135835153%7Ctwgr%5E%7Ctwcon%5Es1_&amp;ref_url=https%3A%2F%2Fwww.cnbc.com%2F2022%2F04%2F07%2Fketanji-brown-jackson-confirmed-to-supreme-court-first-black-woman-justice.html\"><span style=\"font-weight: 400\">wrote in a tweet<\/span><\/a><span style=\"font-weight: 400\"> after the confirmation. \u201cWe\u2019ve taken another step toward making our highest court reflect the diversity of America.\u201d&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400\">Although Judge Jackson is a much-needed figure on the Court, she will not be doing much. Wade, <\/span><a href=\"https:\/\/www.latimes.com\/politics\/story\/2021-11-03\/supreme-court-the-right-to-carry-a-loaded-gun#:~:text=The%20Supreme%20Court%20under%20stormy%20skies%20in%20Washington%20in%202019.&amp;text=The%20Supreme%20Court's%20justices%2C%20citing,carry%20concealed%20guns%20in%20public.\"><span style=\"font-weight: 400\">expanding Second Amendment protections<\/span><\/a><span style=\"font-weight: 400\"> for carrying guns in public, and <\/span><a href=\"https:\/\/www.npr.org\/2022\/02\/28\/1082934438\/supreme-court-to-hear-a-case-that-could-limit-the-epas-power-to-fight-climate-ch\"><span style=\"font-weight: 400\">limiting the Environmental Agency\u2019s ability to address climate change<\/span><\/a><span style=\"font-weight: 400\">.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400\">Although Judge Jackson is a qualified, hard-working judge, there is absolutely no reason to think that she will have any more of a chance to stop the court\u2019s right-leaning decisions on big cases like these.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400\">Judge Jackson will have to work on cases that discuss affirmative action, like the case of <\/span><a href=\"https:\/\/www.lawyerscommittee.org\/students-for-fair-admissions-sffa-v-university-of-north-carolina-at-chapel-hill\/\"><span style=\"font-weight: 400\">admissions at the University of North Carolina<\/span><\/a><span style=\"font-weight: 400\">.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400\">There is no evidence showing how Judge Jackson may approach the case, but many are confident she will vote to uphold programs in which colleges and universities will have to consider race among other factors during admissions decisions.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400\">She will also have to participate in a recent clash of religious freedom and gay rights. It is a similar case to a <\/span><a href=\"https:\/\/www.cnn.com\/2018\/06\/04\/politics\/masterpiece-colorado-gay-marriage-cake-supreme-court\/index.html\"><span style=\"font-weight: 400\">2018 dispute about a Colorado baker<\/span><\/a><span style=\"font-weight: 400\">, though this time a <\/span><a href=\"https:\/\/www.cnn.com\/2022\/02\/22\/politics\/supreme-court-same-sex-marriage-religious-liberty\/index.html\"><span style=\"font-weight: 400\">web designer objects to providing services for same-sex weddings<\/span><\/a><span style=\"font-weight: 400\">.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400\">In another major case that is already on the court\u2019s docket for the next term, Judge Jackson will have to consider the role race may play in voting maps. The court has already dealt with this in February when it <\/span><a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/21a375_d18f.pdf\"><span style=\"font-weight: 400\">reinstated an Alabama congressional map<\/span><\/a><span style=\"font-weight: 400\"> that diluted the power of Black voters.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400\">The court will hear an appeal in the same case just after Judge Jackson arrives. However, it is looking as if the votes of the conservative justices are leaning towards limiting the force of the Voting Rights Act of 1985, something that <\/span><a href=\"https:\/\/www.justice.gov\/crt\/about-section-5-voting-rights-act#:~:text=On%20June%2025%2C%202013%2C%20the,570%20U.S.%20529%20(2013).\"><span style=\"font-weight: 400\">the Supreme Court has previously done<\/span><\/a><span style=\"font-weight: 400\">.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400\">Because of the conservative supermajority, Judge Jackson will not be able to have an impact on any of these cases.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400\">Even though she will not be able to make any immediate change, she might be able to in the future. She is only 51, and she will most likely serve for decades to come. In that time, the court will likely change, and its direction might, too.
