{"id":36543,"date":"2023-03-23T22:50:18","date_gmt":"2023-03-24T03:50:18","guid":{"rendered":"https:\/\/sites.imsa.edu\/acronym\/?p=36543"},"modified":"2023-03-23T22:50:18","modified_gmt":"2023-03-24T03:50:18","slug":"planned-israeli-judicial-overhaul-legalized-settlements-in-occupied-palestinian-territories","status":"publish","type":"post","link":"https:\/\/sites.imsa.edu\/acronym\/2023\/03\/23\/planned-israeli-judicial-overhaul-legalized-settlements-in-occupied-palestinian-territories\/","title":{"rendered":"Planned Israeli Judicial Overhaul, Legalized Settlements in Occupied Palestinian Territories"},"content":{"rendered":"<p>On Tuesday, February 21st, Israel\u2019s parliament, the Knesset, <a href=\"https:\/\/apnews.com\/article\/politics-israel-government-united-states-benjamin-netanyahu-5d586384e4eff2b60c4af8e5245fc283\">voted<\/a> 63\u201347 to advance a plan that would give Prime Minister Benjamin Netanyahu\u2019s coalition government increased power over the Israeli judiciary. <a href=\"https:\/\/www.reuters.com\/world\/middle-east\/netanyahu-government-unveils-plan-reform-israels-top-court-2023-01-04\/\">According<\/a> to Justice Minister Yariv Levin, the plan would allow the Knesset a greater say in the selection of judges appointed to the country\u2019s Supreme Court. It would also give the Knesset the power to override the court\u2019s rulings by a 61-of-120-seat majority so long as the rulings are not unanimous.<\/p>\n<p>Under the plan, the Supreme Court <a href=\"https:\/\/apnews.com\/article\/politics-israel-government-united-states-benjamin-netanyahu-5d586384e4eff2b60c4af8e5245fc283\">would be unable<\/a> to overturn \u201c<a href=\"https:\/\/m.knesset.gov.il\/en\/activity\/pages\/basiclaws.aspx\">Basic Laws<\/a>,\u201d foundational laws that stand in for the constitution Israel does not have. Among these laws are highly controversial pieces of legislation, such as the nation-state<a href=\"https:\/\/www.jpost.com\/Israel-News\/Read-the-full-Jewish-Nation-State-Law-562923\"> law<\/a>, which <a href=\"https:\/\/www.vox.com\/world\/2018\/7\/31\/17623978\/israel-jewish-nation-state-law-bill-explained-apartheid-netanyahu-democracy\">sets<\/a> the legal framework for discrimination against Arabs.<\/p>\n<p>Critics <a href=\"https:\/\/apnews.com\/article\/politics-israel-government-united-states-benjamin-netanyahu-5d586384e4eff2b60c4af8e5245fc283\">say<\/a> the plan would allow lawmakers to designate any law a Basic Law, effectively shielding the law from the courts.<\/p>\n<p>Critics also <a href=\"https:\/\/apnews.com\/article\/politics-israel-government-united-states-benjamin-netanyahu-5d586384e4eff2b60c4af8e5245fc283\">say<\/a> the plan would allow Netanyahu, who has been on trial for nearly three years, to escape the charges of accepting bribes, fraud, and breach of trust that he currently faces. Citing conflict of interest, Israel\u2019s attorney general has prevented Netanyahu from being involved in the effort to pass the plan.<\/p>\n<p>Having been <a href=\"https:\/\/www.theguardian.com\/world\/2021\/jun\/13\/benjamin-netanyahu-ousted-israel-prime-minister-coalition-12-years\">replaced<\/a> by centrist opposition leader Yair Lapid as prime minister in 2021, Netanyahu and his Likud party returned to power in December 2022. They were <a href=\"https:\/\/www.bbc.com\/news\/world-middle-east-64115141\">joined<\/a> by their ultranationalist and ultra-Orthodox Jewish allies, forming a coalition government under the <a href=\"https:\/\/www.bbc.com\/news\/world-middle-east-64115141\">guiding principle<\/a> that \u201cthe Jewish people have an exclusive and unquestionable right to all areas of the land of Israel.\u201d<\/p>\n<p>With the plan\u2019s introduction, Netanyahu\u2019s opponents and allies have both <a href=\"https:\/\/apnews.com\/article\/politics-israel-government-united-states-benjamin-netanyahu-5d586384e4eff2b60c4af8e5245fc283\">claimed<\/a> that the country\u2019s democracy is at risk. Still, many of Netanyahu\u2019s allies say that the judicial overhaul is necessary to limit the power of an unelected judiciary. Critics warn that Netanyahu will pack the Court with the prime minister\u2019s own supporters.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Internal Criticism&nbsp;<\/strong><\/p>\n<p>Since the overhaul was announced, upwards of <a href=\"https:\/\/jewishunpacked.com\/what-is-going-on-with-israels-planned-judicial-reforms\/\">100,000<\/a> Israelis have attended protests throughout the country. The protestors have <a href=\"https:\/\/foreignpolicy.com\/2023\/02\/23\/israel-judicial-reform-protests-netanyahu-government-supreme-court\/\">included<\/a> many sects of the Israeli public that rarely participate in demonstrations, such as tech employees, former government officials, religious Zionists from Netanyahu\u2019s Likud party, settlers, and others. They claim that the reforms will <a href=\"https:\/\/jewishunpacked.com\/what-is-going-on-with-israels-planned-judicial-reforms\/\">destroy<\/a> democracy in the country.<\/p>\n<p><a href=\"https:\/\/jewishunpacked.com\/what-is-going-on-with-israels-planned-judicial-reforms\/\">According<\/a> to Netanyahu, the coalition government \u201creceived a clear and strong mandate from the public to carry out what we promised in the elections, and we will do so. [The judicial reform] is the realization of the voters\u2019 will and this is the essence of democracy.\u201d<\/p>\n<p>When announcing the plan, Levin echoed Netanyahu, presenting it as a defense of democracy against unelected judges. \u201cThere are judges, but there is also a parliament and a government,\u201d he <a href=\"https:\/\/www.israelhayom.com\/2023\/01\/05\/justice-minister-introduces-plan-to-curtail-power-of-judiciary\/\">said<\/a>. \u201cDemocracy is in danger when we vote in the ballot box but each time officials that were not elected decide for us.\u201d<\/p>\n<p>Protestors argue against the coalition\u2019s narrative, saying that they never gave Netanyahu their permission to overhaul the judiciary. At a recent rally, Avi Himi, chair of the Israel Bar Association, <a href=\"https:\/\/jewishunpacked.com\/what-is-going-on-with-israels-planned-judicial-reforms\/\">said<\/a> to his crowd, \u201cYou never got a mandate to change the regime, you never got a mandate to destroy democracy. It\u2019s our right to scream, it\u2019s our obligation to scream, that\u2019s how it is in a democracy.\u201d<\/p>\n<p>On March 1st, a group of 740 Israeli activists sent a letter to the US Secretary of State, Antony Blinken, <a href=\"https:\/\/www.state.gov\/briefings\/department-press-briefing-march-2-2023\/#post-426098-ispal\">saying<\/a> that \u201cas far as the Netanyahu government is concerned, the two-state solution is dead.\u201d In the letter, they <a href=\"https:\/\/www.jpost.com\/israel-news\/politics-and-diplomacy\/article-733192\">asked<\/a> that the US press sanctions against Israel.<\/p>\n<p>Israeli Supreme Court President Esther Hayut <a href=\"https:\/\/www.jpost.com\/israel-news\/politics-and-diplomacy\/article-728405\">shares<\/a> protestors\u2019 concerns. During the Israeli Association of Public Law\u2019s January convention, she warned, \u201cIf the people who made up this plan have their way, the 75th year [since Israel\u2019s founding] will be remembered as the year in which Israel\u2019s democracy suffered a fatal blow.\u201d<\/p>\n<p>Hayut went on to stress the importance of an independent supreme court in protecting human rights. An independent court, she <a href=\"https:\/\/www.jpost.com\/israel-news\/politics-and-diplomacy\/article-728405\">told<\/a> the convention, is necessary to ensure that \u201cthe rule of the majority does not turn into the tyranny of the majority.\u201d<\/p>\n<p>Others, such as the governors of the Bank of Israel, <a href=\"https:\/\/www.france24.com\/en\/live-news\/20230302-controversial-israeli-legal-reforms-spark-fears-for-economy\">fear<\/a> that the plan could deal a \u201csevere blow to the economy.\u201d Key figures in the tech sector\u2014which accounts for 15% of the country\u2019s GDP and more than half of the country\u2019s exports\u2014have joined the protests, applying significant pressure to lawmakers of the self-proclaimed \u201cstart-up nation.\u201d<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Internal Support&nbsp;<\/strong><\/p>\n<p>Other Israelis embrace the reforms. On March 2nd, a petition in support of the reforms, already signed by a group of 120 academics, was launched. Signatories come from professors at top Israeli universities, including the Weizmann Institute of Science and Tel Aviv University.<\/p>\n<p>Organized by Hebrew University of Jerusalem professor and Nobel laureate Robert Aumann, the petition <a href=\"https:\/\/www.jpost.com\/israel-news\/politics-and-diplomacy\/article-733192\">claims<\/a> that the Supreme Court has become too powerful. Particularly, they cite the Court\u2019s jurisdiction over both regular and Basic Laws and its increased ability to pass judgment on the \u201c<a href=\"https:\/\/www.timesofisrael.com\/levin-unveils-bills-to-weaken-top-court-enable-laws-to-be-immune-to-judicial-review\/\">reasonableness<\/a>\u201d of parliamentary decisions as disrupting Israel\u2019s balance of power.<\/p>\n<p>A response to roughly 700 other Israeli academics\u2019 opposition to the reforms, the petition does <a href=\"https:\/\/www.jpost.com\/israel-news\/politics-and-diplomacy\/article-733192\">call<\/a> for the terms of the overhaul to be negotiated until they are broadly accepted.<\/p>\n<p>Others see the reforms as the latest development in their battle against the liberal Supreme Court for the \u201c<a href=\"https:\/\/foreignpolicy.com\/2023\/02\/23\/israel-judicial-reform-protests-netanyahu-government-supreme-court\/\">soul of Israel<\/a>.\u201d Carnegie Mellon Endowment for International Peace Senior Fellow Aaron David Miller points out that \u201cit was often the court, not the Knesset, that delivered equal rights for LGBTQ Israelis, women and minorities,\u201d making the court a target for anyone aiming to suppress these groups.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>International Criticism<\/strong><\/p>\n<p>Major US figures have indicated that the Biden Administration does not support Netanyahu\u2019s overhaul.<\/p>\n<p>In a statement to the <i>New York Times, <\/i>Biden <a href=\"https:\/\/www.timesofisrael.com\/biden-in-first-direct-comment-on-judicial-overhaul-urges-consensus-building\/\">wrote<\/a> that \u201cthe genius of American democracy and Israeli democracy is that they are both built on strong institutions, on checks and balances, on an independent judiciary. Building consensus for fundamental changes is really important to ensure that the people buy into them so they can be sustained.\u201d<\/p>\n<p>Speaking for the Biden Administration, US Ambassador to Israel Tom Nides has also <a href=\"https:\/\/www.timesofisrael.com\/us-envoy-were-telling-netanyahu-to-pump-the-breaks-on-judicial-overhaul-push\/\">warned<\/a> Netanyahu\u2019s government to \u201cpump the brakes\u201d on the judicial overhaul.<\/p>\n<p>In the CNN podcast interview, Nides <a href=\"https:\/\/www.cnn.com\/audio\/podcasts\/axe-files\/episodes\/4074ff47-64fb-4ac6-8192-afab00064526\">reiterated<\/a> that \u201cthe one thing that binds our countries together is a sense of democracy and a sense of democratic institutions\u2026That is how we defend Israel at the UN.\u201d<\/p>\n<p>Jewish groups from around the world, including the traditionally-neutral North American Jewish Federations, have opposed the overhaul as well. In a public letter addressed to Netanyahu and Lapid, the organization <a href=\"https:\/\/www.timesofisrael.com\/in-break-from-policy-major-us-jewish-group-decries-proposed-judicial-overhaul\/\">wrote<\/a>, \u201cWe recognize that any system of checks and balances will be different than those in our own countries, but such a dramatic change to the Israeli system of governance will have far-reaching consequences in North America, both within the Jewish community and in the broader society.\u201d<\/p>\n<p>\u201cThe essence of democracy,\u201d the group <a href=\"https:\/\/www.timesofisrael.com\/in-break-from-policy-major-us-jewish-group-decries-proposed-judicial-overhaul\/\">continued<\/a>, \u201cis both majority rule and the protection of minority rights.\u201d<\/p>\n<p>This criticism from governments and organizations worldwide comes as tension mounts between Israeli settlers and Palestinians.<\/p>\n<p>On March 1st, Israeli Minister of Finance Bezalel Smotrich, who handles civil administration in the occupied West Bank, was quoted as <a href=\"https:\/\/www.aljazeera.com\/news\/2023\/3\/1\/israel-arrests-settlers-after-anti-palestinian-pogrom\">saying<\/a>, \u201cI think the village of Huwara needs to be wiped out. I think the state of Israel should do it.\u201d<\/p>\n<p>This comment came after far-right Israeli settlers set fire to dozens of houses and cars in the occupied West Bank village in response to the killing of two Israeli brothers by a Palestinian gunman.<\/p>\n<p>Though the US is an ally to Israel, US Department of State spokesperson Ned Price <a href=\"https:\/\/www.state.gov\/briefings\/department-press-briefing-march-1-2023\/#post-425583-ISRAEL\">condemned<\/a> Smotrich\u2019s remarks as \u201cirresponsible,\u201d \u201crepugnant,\u201d and \u201cdisgusting\u201d during a March 1st press briefing. \u201cWe call on Prime Minister Netanyahu and other senior Israeli officials to publicly and clearly reject and disavow these comments.\u201d<\/p>\n<p>Netanyahu has since <a href=\"https:\/\/www.nbcnews.com\/news\/world\/israel-benjamin-netanyahu-bezalel-smotrich-hawara-village-wiped-out-rcna73444\">tweeted<\/a> that \u201cit is important for all of us to work to tone down the rhetoric [and] lower the temperature.\u201d He proceeded to indirectly label Smotrich\u2019s comment as \u201cinappropriate\u201d while suggesting that the finance minister had misspoken: \u201cThat includes speaking out forcefully against inappropriate statements and even correcting our own statements when we misspeak or when our words are taken out of context.\u201d<\/p>\n<p>At a UN Human Rights Council meeting following Smoltrich\u2019s comment, UN High Commissioner for Human Rights Volker T\u00fcrk <a href=\"https:\/\/www.aljazeera.com\/news\/2023\/3\/3\/un-rights-chief-israel-minister-inciting-violence\">said<\/a>, \u201cThe situation in the occupied Palestinian territory is a tragedy, a tragedy above all for the Palestinian people.\u201d<\/p>\n<p>T\u00fcrk continued to highlight the atrocities that Israel has carried out against the Palestinian people. Referring to a report he was presenting on the occupied territories, he <a href=\"https:\/\/www.aljazeera.com\/news\/2023\/3\/3\/un-rights-chief-israel-minister-inciting-violence\">said<\/a>, \u201cMy report finds that over the reporting period, lethal force has been frequently employed by the Israeli security forces regardless of the level of threat and at times even as an initial measure rather than as a last resort.\u201d<\/p>\n<p>T\u00fcrk <a href=\"https:\/\/www.aljazeera.com\/news\/2023\/3\/3\/un-rights-chief-israel-minister-inciting-violence\">reported<\/a> that \u201c131 Palestinians were killed by ISF personnel over the past year in a context of law enforcement that is outside any context of hostilities,\u201d including \u201c65 people who we understand were not armed nor engaged in any attacks or clashes.\u201d<\/p>\n<p>A few days earlier, on February 20th, the UN Security Council unanimously <a href=\"https:\/\/apnews.com\/article\/politics-israel-government-united-states-nations-13d6e12e5f052e9a0ffc77952b8781e4\">approved<\/a> a \u201cwatered-down statement strongly opposing Israel\u2019s continued construction of settlements.\u201d<\/p>\n<p>According to <i>AP News, <\/i>the Palestinian-backed draft resolution would \u201calmost certainly\u201d have been <a href=\"https:\/\/apnews.com\/article\/politics-israel-government-united-states-nations-13d6e12e5f052e9a0ffc77952b8781e4\">vetoed<\/a> by Israel\u2019s closest ally, the US.<\/p>\n<p>As published, the <a href=\"https:\/\/documents-dds-ny.un.org\/doc\/UNDOC\/GEN\/N23\/052\/50\/PDF\/N2305250.pdf?OpenElement\">statement<\/a> \u201cexpresses deep concern and dismay with Israel\u2019s announcement [of] further construction and expansion of settlements and the \u201clegalization\u201d of settlement outposts\u201d and emphasizes UN support for the two-state solution.<\/p>\n<p>In response, Netanyahu\u2019s office <a href=\"https:\/\/apnews.com\/article\/politics-israel-government-united-states-nations-13d6e12e5f052e9a0ffc77952b8781e4\">issued<\/a> a statement claiming that the UN statement \u201cnegates the rights of Jews to live in their historical homeland, ignores Palestinian terror attacks in Jerusalem in which 10 Israeli citizens were murdered this month, turns a blind eye to the fact that the Palestinian Authority subsidizes terror and pays the families of terrorists, and diminishes the antisemitism that led to the murder of millions of Jews.\u201d<\/p>\n<p>Riyad Mansour, Palestinian ambassador to the UN, <a href=\"https:\/\/apnews.com\/article\/politics-israel-government-united-states-nations-13d6e12e5f052e9a0ffc77952b8781e4\">welcomed<\/a> the statement.
